Are You Eligible for Veterans Disability Benefits?

Both of these requirements are needed to receive VA Disability Benefits:

  • The veteran must have a current illness or injury (condition), which can include a mental condition, and
  • The veteran served in the Armed Forces in active duty, active duty for training, or inactive duty training.

Examples of proof of injury or causation during service that give rise to VA Disability Compensation:

  • Sustained an injury during service, such as from a fall during training.
  • Experiencing PTSD, depression, anxiety, or another mental health condition due to experiences of service.
  • A disease or condition that is linked to exposure to toxic substances during service.  For example, cancer caused by exposure to contaminated water.
  • A condition or illness caused by a condition that VA  has determined is service-connected.  Secondary service connection can be granted for the secondary condition.  For example, sleep apnea caused by service-connected PTSD and depression.
  • In proving these connections, presumptions may be available, such that service connection is granted based on service in a particular geography.

What Do VA Benefits Cover?

Tax-free disability benefits can cover a range of financial issues for veterans. The benefits are  intended to make up for the loss of income-earning potential due to the disability.

  • Health care: Surgeries, medical treatments, health exams, dialysis, acute care, and specialized care such as organ transplants, intensive care for mental and physical health conditions, and medical care for traumatic injuries, and both inpatient and outpatient services.
  • Urgent medical care: If a condition requires immediate medical care, the benefits can cover the cost of medical intervention in non-life-threatening conditions.
  •  Mental health services: These treatments are provided for veterans suffering from PTSD, military sexual trauma, or other mental conditions.
  • Preventative care: Examinations, education, including nutrition, immunization, and counseling for genetic diseases.
  • Home health care or assisted living: Some conditions require home health care or 24/7 nursing and medical care, physical therapy, help performing daily tasks, comfort care, and pain management, which could be delivered at live-in facilities.  VA benefits can cover the cost of increased care needed due to service-connected disabilities.
  • Education: VA benefits can cover a variety of educational programs, covering the cost of tuition, fees, books, and a payment to help with monthly housing. The types of educational programs include college, vocational training, apprenticeships, and others.

Disability Benefits for Veterans: Trusted Atlanta Law Firm

Your condition will be given a “disability rating” from the VA. This rating will be issued based on the supporting documentation on your condition that our firm has submitted on your behalf. A disability rating is how the VA will quantify the severity of your service-related injury or illness.
